The controller for data processing on this website is: Up2date, Kenneth Kurmann, Dorfstrasse 19, 6362 Stansstad, Switzerland. Email: info@nextgen-swiss.com.
02Data collected
When you visit this website, the hosting provider automatically processes technical access data (server logs): IP address, date and time of access, page requested, referrer, browser type and operating system.
This website sets no cookies and loads no content from third-party servers; fonts are served locally.
03Purpose of processing
The technical access data serves solely the secure and stable operation of the website: delivering content, analyzing errors and fending off attacks. No marketing analysis takes place.
04Legal basis
Processing is governed by the Swiss Federal Act on Data Protection (FADP). Where the GDPR applies — for instance to visitors from the EU —, processing of access data is based on our legitimate interest in operating the website securely (Art. 6(1)(f) GDPR).
05Hosting (Vercel, USA)
This website is hosted by Vercel Inc., 340 S Lemon Ave #4133, Walnut, CA 91789, USA. The server logs mentioned under "Data collected" are processed by Vercel on our behalf; data may be transferred to the USA in the process.
Vercel is certified under the EU-U.S. Data Privacy Framework and its Swiss extension (Swiss-U.S. DPF), which provides a recognized adequate level of data protection for this transfer.
06YouTube videos
This website embeds videos from YouTube. Opening a page establishes no connection to YouTube — we serve the preview images ourselves. Only when you start a video by clicking does the player load from youtube-nocookie.com in privacy-enhanced mode (YouTube, operated by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland); data may then be transferred to Google, including to the USA.
The embedding is based on your active decision to play the video (where the GDPR applies: Art. 6(1)(a) GDPR).
07Form processing
When you submit the application form (Apply), we process the data you provide: the selected track (creator or brand), your answers — such as channel link or company name, platform, channel size or campaign goal, requested services and budget range — and your email address. The sole purpose is handling and answering your request (Art. 6(1)(b) GDPR; Swiss revFADP).
To receive form data we use Formspark, a service by Trampoline Software SRL, Rue de Marsannay-la-Côte 16, 5032 Mazy, Belgium, acting as our processor (Art. 28 GDPR, data processing agreement). Transmission is encrypted; data is stored within the EEA (Ireland and Germany).
We delete form data once your request has been dealt with, at the latest twelve months after receipt. For abuse and spam prevention, Formspark additionally stores the IP address and approximate location for twelve months.
08Analytics
This website uses no analytics or statistics tools and no tracking services. Should that change, this policy will be updated beforehand.
09Your rights
You have the right to information about the data processed about you, and to have it corrected or deleted. Where the GDPR applies, you additionally have the rights to restriction of processing, to data portability and to object.
You can also lodge a complaint with a supervisory authority — in Switzerland the Federal Data Protection and Information Commissioner (FDPIC), in the EU the competent data protection authority.
